Abstract
The guarantees of the military personnel of the Russian Federation, which are an element of their constitutional and legal status, presuppose the formation of additional conditions conducive to the implementation of the functions of military personnel, their rehabilitation and protection in the Russian Federation. The purpose of this study is to analyze and systematize the system of guarantees for military personnel in the Russian Federation, taking into account their participation in a special military operation. The research methodology is based on the following mechanisms: generalization of theoretical material regarding the concept of human rights guarantees as the basis for the status of military personnel in the Russian Federation; analysis of the content of regulatory legal acts at the federal and regional levels that establish special measures of state support for military personnel in the Russian Federation and their family members, taking into account the implementation of a special military operation; comparative study of special guarantees established for different categories of military personnel in the Russian Federation participating in a special military operation. The conclusion is formulated that the constitutional and legal guarantees of military personnel in the Russian Federation are based on the restrictions and prohibitions established for this category of employees, their system is highlighted and the need to bring into equal status the military personnel of the Russian Federation who have signed a contract and are participating in a special military operation, regardless of the date and method of conclusion of the contract, as well as mobilized citizens. To this end, it is necessary to supplement the federal law “On the Status of Military Personnel” and consolidate equal support measures for the subjects of constitutional and legal relations under consideration.
