CONSTITUTIONAL AND LEGAL ASPECTS OF POST-SOVIET COUNTRIES’ PARTICIPATION IN THE ORGANIZATION OF TURKIC STATES

Abstract

Participation of post-Soviet countries in international organizations of the integration type actualizes the issues of the form and degree of membership in integration associations, the transfer of some state powers to the institutions of such associations, as well as the relationship of national law and the Constitution with international (integration) law. The purpose of the article is to study the features of constitutional and legal regulation of interstate integration in post-Soviet countries and search for optimal approaches to improve existing legal mechanisms. The research methodology is based on the principle of pluralism with an approach of integrated use of a variety of approaches chosen within the framework of the research, among which are interdisciplinary, comparative-legal and systemic-structural. According to the results of the study, the current state of constitutional and legal regulation of mechanisms of some post-Soviet countries’ participation in integration associations is assessed, the main problems are identified and solutions concerning the correlation of national and international law are substantiated. In conclusion, it is noted that with the current regulation of post-Soviet countries’ participation in integration associations, in particular, the further development of cooperation within the framework of the Organization of Turkic States, the deepening of integration processes may be accompanied by the emergence of certain legal conflicts and crises.
