The Institute for Restricting the Rights of Foreign Citizens in the Implementation of Migration Policy and Ensuring National Security of Russia

Abstract

The article is devoted to the analysis of legal restrictions on the rights of foreign citizens in context of the state migration policy of Russia and ensuring national security. It is emphasized that the establishment and implementation of migration policy, including the establishment of necessary restrictions on rights and freedoms of foreign citizens, is the sovereign right of the Russian state. The purpose of the article is to systematize existing legal restrictions on the rights of foreign citizens in Russia and to develop new restrictions on the rights of foreign citizens in order to ensure Russia’s national security. The research methodology includes an analysis of Russian legislation, decisions of the Constitutional Court of the Russian Federation, and the practice of applying migration legislation in Russia and foreign countries. The results of the study include proposals for improving Russian legislation. In conclusion, it is noted that the Russian state has the sovereign right to establish restrictions on the rights of foreign citizens in federal laws and apply them in order to protect the foundations of the constitutional order, morality, health, rights and legitimate interests of citizens of the Russian Federation, and to ensure the country’s defense and state security.
