Problems of the “Land Dispute” Concept Qualification in the Russian Legislation and Possible Ways of Their Solution

Abstract

Issues related to the introduction of the official definition of the concept of “land dispute” into the current Russian legislation are considered. The methodology of the presented research is based on the systematization of scientific views in the field of land relations, as well as on an integrated approach to the analysis of current land legislation. The purpose of this publication is to find possible ways to qualify the concept of “land dispute” and to formalize it in the Russian legislation. Based on the analysis of land law norms, as well as the existing points of view of representatives of the science of land law on the issue under consideration, the author’s approach to determining the concept of “land dispute” is formulated and proposed. The need to establish a common unified concept of the classification of land disputes is emphasized and an original approach to such classification is proposed. As the results of the conducted research, the author formulated proposals for improving the current legislation.
